Terms of Service
These Terms govern your use of the Pisonics website, cloud platform and mobile application. Please read them carefully — by using our services you agree to be bound by them.
1. Acceptance and scope
By accessing this website, registering an account on the cloud platform, or installing and using the mobile application, you confirm that you have read, understood and accepted these Terms. If you do not agree, please stop using the services.
If you use the services on behalf of a company or organisation, you represent that you are authorised to accept these Terms on its behalf.
2. The services
We provide: (a) this website, offering product, technical and company information; (b) the Pisonics cloud platform, for remote viewing, configuration and firmware maintenance of your online density / concentration meters; and (c) the mobile application, which connects to your instruments over the cloud or directly over Bluetooth.
Access to the cloud platform and to specific devices is granted by account and by permission level. You may only access devices you own or have been explicitly authorised to access.
3. Accounts and security
You agree to provide accurate registration information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity conducted under your account.
Please notify us immediately if you discover unauthorised use of your account. We may suspend an account where we reasonably believe it has been compromised or is being used in breach of these Terms.
4. Acceptable use
You agree not to:
- use the services for any unlawful purpose, or in breach of applicable regulations;
- access, or attempt to access, devices or data you are not authorised to access;
- interfere with, overload, probe or attack the services or their supporting infrastructure;
- reverse-engineer, decompile or extract source code from the software or firmware, except where such restriction is prohibited by law;
- resell, sublicense or otherwise commercially exploit the services without our written consent.
5. Measurement data and disclaimer
Important. Measurements, curves and statistics provided through the services are intended to assist process monitoring and analysis. Readings depend on correct installation, calibration and actual process conditions.
You must exercise independent judgement together with on-site conditions and other instruments or procedures. Do not rely on the output of the services as the sole basis for safety interlocks, emergency shutdown, or custody-transfer settlement. We are not liable for indirect losses arising from data deviation or unavailability caused by installation, calibration, changing process conditions, power or network interruption.
6. Intellectual property
All intellectual property rights in the website, cloud platform, mobile application, device firmware, documentation, trademarks and content remain with us or our licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the services for their intended purpose; no other rights are granted.
Measurement data generated by your own instruments belongs to you. You grant us the limited right to process and store it as necessary to provide the services (see the Privacy Policy).
7. Personal data
Our collection and use of personal data is described in the Privacy Policy, which forms part of these Terms. For cookie details see the Cookie information page.
8. Third-party services
The services may rely on third-party infrastructure (such as cloud hosting, mobile networks, SMS/e-mail delivery and analytics). We select providers with care but are not responsible for interruptions or faults originating from them.
9. Changes, suspension and termination
We may update, improve or adjust the services, and may suspend them temporarily for maintenance, upgrade or security reasons. Where practicable we will give advance notice of planned interruptions.
You may stop using the services at any time. We may suspend or terminate access where you materially breach these Terms, or where required by law or by a competent authority.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential losses, including loss of production, loss of profit or loss of data, arising out of the use of or inability to use the services.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for personal injury or death caused by negligence, or for wilful misconduct.
11. Changes to these Terms
We may revise these Terms from time to time. The "last updated" date above reflects the latest revision. Material changes will be brought to your attention through the website or application. Continued use after a change takes effect constitutes acceptance of the revised Terms.
12. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China. Any dispute that cannot be resolved through friendly negotiation shall be submitted to the people's court with jurisdiction at the place where Xi'an Pisonics Information Technology Co., Ltd. is domiciled.
